Nesting Birds and Seasonal Work Restrictions
All wild birds, their nests, and eggs are protected under UK law. The main nesting season runs from March to August, but some species nest outside this period. Disturbing nesting birds during construction work is a criminal offence that can lead to prosecution and project delays. This talk explains how to identify nesting activity, what restrictions apply, and what every operative must do if they find a nest.

Control Measures
- Schedule vegetation clearance, demolition, and site stripping outside the main nesting season where possible.
- Commission a nesting bird survey by a qualified ecologist before clearing any vegetation between March and August.
- Stop work immediately and establish a buffer zone if an active nest is discovered during operations.
- Report any suspected nesting activity to the site environmental manager without delay.
- Install bird deterrents or exclusion netting before nesting season where approved by the project ecologist.
- Brief all operatives on nest identification and the legal requirement not to disturb nesting birds.
- Keep a watching brief during all site clearance activities in or near potential nesting habitat.
- Mark exclusion zones around active nests with clearly visible fencing and signage.
- Do not resume work in the exclusion zone until the ecologist confirms the nest is no longer active.
